In connection with the European Court of Human Rights proceedings, Zubaydah filed suit in the U.S. seeking disclosure of information related to the matter. The U.S. government intervened, seeking to assert a state secrets privilege. The U.S. district court decided in favor of the government and dismissed the case. On appeal, the dismissal was reversed on a ruling that the state secrets privilege did not apply to information that was already publicly known. The Supreme Court reversed the appeal ruling in ''[[United States v.
