==Swiss constitutional prohibition==
The first [[Swiss Federal Constitution|Swiss constitution]], as amended in 1848, forbade all military capitulations,<ref>Bundesverfassung, 12 September 1848, Artikel 11.</ref> a federal law, as amended 30 September 1859, all military capitulations and recruitment of Swiss by foreign powers,<ref>Bundesgesetz betreffend die Werbung und den Eintritt in den fremden Kriegsdienst, Artikel 1.</ref> although volunteering of individuals in foreign armies continued until prohibited outright in 1927.<ref>Militärstrafgesetz, as amended 13 June 1927, Artikel 94.</ref> The Papal [[Swiss Guard]], reflecting the particular status of the [[Holy See]] and the [[Vatican City State]] and the character of the unit as a [[bodyguard]], <ref name="BR"/> remains an exception to this prohibition, explicitly defined between the parties.
