Because Infanticide is punishable as manslaughter, as per s24,<ref>{{cite Legislation AU|NSW|act|ca190082|Crimes Act 1900|24}} Manslaughter – punishment.</ref> the maximum penalty for this offence is therefore 25 years imprisonment.
