Divorce by Agreement (rikon), occurs when both parties mutually agree to separate and do not need to go to court. This is the most common type of divorce in Japan. Divorce by Conciliation (chotei rikon) is sought out when individuals are unable to agree on terms or separate. Thus, these cases go to court in hope to come to a mutual agreement for both parties. Lastly, Divorce by Judgement (saiban rikon) occurs when individuals are unable to reach an agreement in court during conciliation. Divorce by judgement is uncommon in Japan.
