''Habeas corpus'' is explicitly stated in article 8 of the [[Constitution of the Republic of China]], in which guarantees that anyone has the right to request a writ of ''habeas corpus'' for himself or any other person that is being detained by any organization or individual other than courts. Also, courts shall not reject the request, nor order the detainer to investigate and report before surrendering the detainee; the detainer must bring the person in question to the court within 24 hours without condition, and the detainee shall be released on the spot if the detention is deemed illegal.
