MGM argued that they had the rights to make any authorized sequel to the original book, tracing their claim back to an agreement LaMotta and co-author Peter Savage made with Chartoff-Winkler, producers of the original film. MGM argued that the defendants were publicly claiming the film to be a sequel to the original film, which they said could "tarnish" the original film's reputation.<ref>Patten, D.
