Breyer generally voted to uphold the [[Affordable Care Act]] since its passage in 2010. He wrote the 7-2 majority opinion in ''[[California v. Texas]]'', a decision on June 17, 2021, holding that Texas and other states lacked standing to sue against the Affordable Care Act's individual mandate. Breyer wrote, "It is consequently not surprising that the plaintiffs cannot point to cases that support them. To the contrary, our cases have consistently spoken of the need to assert an injury that is the result of a statute's actual or threatened enforcement, whether today or in the future."<ref>{{Cite web |date=June 17, 2021 |title=19-840 California v.
